1.1 Agreement to Terms

By accessing or using valamdesign.com (the “Website”) and placing an Order, you agree to be bound by these Terms & Conditions. If you disagree, please do not use the Website.

1.2 Eligibility

You confirm you are at least 18 years old and have legal capacity to enter binding contracts in your jurisdiction (UK/USA).

1.3 Definitions

  • “Customer”: Any person or entity placing an Order.
  • “Order”: Request to purchase jewelry, gemstones, or related services.
  • “Product(s)”: All items offered for sale, including Custom Orders (see Section 1.5).
  • “Custom Order”: Any Product designed or modified per the Customer’s specifications (engraving, bespoke design, stone selection, etc.).

1.4 Product Information & Pricing

  • 1.4.1 We strive for accuracy in images and descriptions, but minor variations (color, natural gemstone characteristics, screen settings) may occur.
  • 1.4.2 All prices display in USD (for US customers) or GBP (for UK customers). If you pay in INR (Indian rupees), the checkout rate is for reference only; the final charge will reflect the currency you chose.
  • 1.4.3 Prices, taxes, and shipping fees may change without notice. Any change does not affect already-confirmed Orders (see Section 1.6).

1.5 Order Placement & Acceptance

  • 1.5.1 After you place an Order, you receive an automated acknowledgment—this is not order acceptance but confirmation of receipt.
  • 1.5.2 We reserve the right to accept or decline any Order at our sole discretion (e.g., out of stock, payment issues, suspected fraud, pricing errors).
  • 1.5.3 Once payment clears and we send a separate Shipping Confirmation, the contract is formed and these Terms & Conditions govern (“Order Acceptance”).

1.6 Payments & Taxes

  • 1.6.1 We accept major credit/debit cards, PayPal, and bank transfers (where available). Payment must clear before shipment.
  • 1.6.2 Customers are responsible for any customs duties, import taxes, or other fees imposed by UK/USA customs authorities upon import. We do not collect these at checkout.

  • Post defamatory, abusive, or infringing content.

1.11 Limitation of Liability & Disclaimer

  • 1.11.1 To the fullest extent permitted by law, Valam Design disclaims all warranties (express or implied) regarding Products, including merchantability, fitness for a particular purpose, or non-infringement.
  • 1.11.2 Under no circumstances will Valam Design be liable for indirect, incidental, special, or consequential damages arising from use of the Website or purchase of Products.
  • 1.11.3 Our total liability for any claim related to Products or website use shall not exceed the total amount you paid for the Product giving rise to the claim.

1.12 Governing Law & Jurisdiction

These Terms & Conditions and any sales are governed by Indian law. Disputes fall under the exclusive jurisdiction of courts in Ahmedabad, India.

1.13 Changes to Terms & Conditions

We may update these Terms at any time. The “Last Updated” date will reflect changes. If material changes occur, we’ll post a prominent notice on the Website. Continued use indicates acceptance.
